By purchasing from Prime Fungi LLC, you agree to the following:

Payment Method Requirements

For any product listing that expressly states that payment must be made by bank transfer, bank transfer is the only accepted method of payment for that product. Although other payment methods may remain visible through Shopify checkout, including credit card and other electronic payment options, such payment methods are not authorized for products designated as bank transfer only.

By placing an order for a product designated as bank transfer only, the purchaser acknowledges and agrees to this payment requirement. Orders submitted using an unauthorized payment method may be canceled and refunded. Where permitted by applicable law, a 10% cancellation fee may be deducted from the refund for an order submitted using an unauthorized payment method.

Prime Fungi LLC reserves the right not to fulfill any order that does not comply with the payment requirements stated in the applicable product listing.

Domestic Orders

Prime Fungi LLC will not be held liable for delays, loss, mishandling, or damage occurring after a package has been transferred to the carrier, except where otherwise required by applicable law. Prime Fungi LLC will not provide refunds or replacements for carrier related issues except where otherwise expressly provided by Prime Fungi LLC or required by applicable law.

International Orders

International shipments do not include needles with liquid cultures. The buyer is solely responsible for all applicable taxes, duties, customs fees, and import requirements.

Prime Fungi LLC will not be held liable for delays, loss, confiscation, seizure, mishandling, or damage occurring after an international package has been transferred to the carrier, including packages held or seized by customs, except where otherwise required by applicable law. Prime Fungi LLC will not provide refunds or replacements for carrier or customs related issues except where otherwise expressly provided by Prime Fungi LLC or required by applicable law.

Culture Use & International Compliance

Cultures and laboratory samples are provided for educational, research, microscopy, and mycology purposes. Where cultivation is permitted, products may be cultivated in accordance with applicable local laws and regulations. Where cultivation is not permitted, the product is sold and must be considered strictly as a laboratory reference and microscopy sample for educational, research, identification, and microscopic examination purposes only.

By purchasing, the buyer is responsible for ensuring that the product and its intended use comply with all applicable laws and regulations in the destination country, state, province, or local jurisdiction. For international shipments, the buyer assumes responsibility for complying with any destination specific import requirements, restrictions, or permit requirements applicable to the product.

Definitions

For purposes of these Terms and Conditions, the terms "culture," "strain," and "genetic line" shall be interpreted broadly to include any fungal isolate, clone, mycelium, mycelial culture, spores, spore prints, spore swabs, liquid culture, agar culture, master culture, slant culture, spawn, tissue culture, fruiting culture, or any propagation, expansion, transfer, subculture, descendant culture, or derivative originating from material supplied by Prime Fungi LLC.

Product Images

Product images are provided for general representation only. The appearance of the product received may vary and is not intended to reflect the exact appearance, color, size, density, morphology, or other physical characteristics of the specific product purchased.

Product Use & Responsibility

All products are sold for lawful use only. Prime Fungi LLC will not be held responsible for misuse, improper handling, storage, cultivation, propagation, or application of its products. The buyer assumes all risks and liabilities associated with their use.

Prime Fungi LLC shall not be liable for losses, damages, or other consequences arising from contamination, viability issues, genetic variation, identification discrepancies, or other characteristics of biological materials, including instances in which a culture may differ from its listed identification or expected characteristics.

Species Identification & Responsibility

Fungal cultures are biological materials and natural variation may occur. While Prime Fungi LLC makes reasonable efforts to correctly identify and label all cultures, no guarantee is made regarding species identification, performance, yield, or suitability for any specific cultivation method.

Purchasers are responsible for conducting proper identification and evaluating cultivation feasibility before attempting cultivation or expansion. Prime Fungi LLC shall not be liable for crop failure, loss of yield, contamination, identification discrepancies, or any economic losses resulting from the use of our cultures. By purchasing and using these cultures, the buyer accepts full responsibility for any outcomes associated with cultivation or propagation.

Biological Material Disclaimer

Fungal cultures are living biological materials. Viability, growth characteristics, and performance may vary depending on storage, handling, environmental conditions, and cultivation practices. Prime Fungi LLC does not guarantee growth success or fruiting results.

Glass Tube Master Slants

In the rare event that a Glass Tube Master Slant arrives non viable, the purchaser must contact Prime Fungi LLC by email within twenty (20) days of confirmed delivery. Claims submitted after this period will not be considered.

Prime Fungi LLC reserves the right to determine eligibility for any replacement. If a replacement is approved, a service fee of ten dollars ($10.00) per slant, plus applicable shipping charges, will apply.

Genetic Stability

Fungal cultures may change over time through subculturing, environmental conditions, or natural genetic variation. Characteristics such as growth rate, morphology, fruiting behavior, color, or other traits may vary after transfer or propagation. Prime Fungi LLC does not guarantee genetic stability or that cultures will maintain the same characteristics after expansion or repeated transfers.

Returns

All sales are final. Products are not returnable or exchangeable. Except where otherwise expressly stated in these Terms and Conditions or required by applicable law, purchases are non refundable.

Restrictions on Resale

Strains are intended solely for the purchaser's personal use in growing mushrooms or fungi. Expanding cultures for the purpose of resale or distribution is strictly prohibited.

The sale, trade, transfer, distribution, or commercial use, whether for compensation or otherwise, of any culture, strain, genetic line, mycelium, mycelial culture, spawn, spores, spore prints, spore swabs, liquid culture, agar culture, slant culture, tissue culture, fruiting culture, grow kit, grow bag, propagation, expansion, subculture, descendant culture, or derivative originating from material supplied by Prime Fungi LLC is prohibited without the express written consent of Prime Fungi LLC.

Order Review & Purchase Limits

Prime Fungi LLC reserves the right to review and limit orders at its discretion. Orders that appear to exceed typical personal cultivation quantities, show unusual purchasing patterns, or raise concerns regarding redistribution may be canceled and refunded without notice.

Prime Fungi LLC may also restrict or suspend future purchases from any customer account or shipping address for a period of time if purchasing activity suggests potential resale, redistribution, or other activity inconsistent with these terms.

Right to Refuse Service

Prime Fungi LLC reserves the right to refuse or cancel any order at its sole discretion, subject to applicable law.

Safety Notice

Not all cultures produce edible mushrooms. Certain species are toxic or otherwise unsafe for consumption, and some individuals may experience sensitivities or allergic reactions. It is the purchaser's responsibility to research the safety of each species.

A sterile needle may be included with your culture, intended only for transferring the culture to a suitable substrate such as sterilized grain, sawdust, peat, or coco coir. Handle with care, and never ingest or inject any culture.

All cultures are not for human or animal consumption. Keep out of reach of children.

Glycerites & Extracts

Glycerite and extract products offered by Prime Fungi LLC are not intended to diagnose, treat, cure, or prevent any disease. Buyers should always seek the advice of their physician or other qualified healthcare provider before using any glycerite or extract, especially if pregnant, nursing, taking medication, or managing a medical condition. Use is at the purchaser's own risk.

Limitation of Liability

To the fullest extent permitted by law, Prime Fungi LLC shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to lost profits, crop loss, business interruption, or economic losses arising from the purchase or use of our products.

To the fullest extent permitted by law, the maximum liability of Prime Fungi LLC shall not exceed the purchase price actually paid for the product giving rise to the claim.

Agreement

Completion of a purchase constitutes acknowledgment of full understanding and acceptance of these Terms and Conditions. Any purchaser who does not fully understand or agree with these conditions should refrain from completing the transaction.

These Terms and Conditions are subject to applicable federal, state, and local laws. Nothing in these Terms and Conditions is intended to waive, exclude, or limit any rights or protections that cannot lawfully be waived, excluded, or limited under applicable law.
